Millbrae Hit and Run Suspect Pleads No Contest, Gets 3 Years Probation

Man was picking up his daughter at school.

Roger Javier Fernandez, 52, was sentenced to three years of supervised probation Feb. 15, after pleading no contest to a charge of possession of a controlled substance resulting from his arrest after a Feb. 18, 2010 hit and run.

Fernandez was picking up his seven year-old daughter at Spring Valley Elementary School, according to police reports, when he jumped the curb. Fernandez gave conflicting stories when he was stopped, but his daughter, according to reports, said she heard a whack and a woman’s scream before she and her father left the area.

Fernandez’s daughter also said he was sorry for hitting the lady, reports said.

When Fernandez was stopped 40 minutes later he was found to have a “bindle” of cocaine, leading to a charge of possession of a controlled substance with intent to sell.

Under the terms of the plea and Proposition 36, Fernandez was sentenced to probation and treatment, in place of serving jail time, as a non-violent offender.
