Millbrae BART Napper Pleads Not Guilty in Transit Worker Attack
Oakland man whacked BART employee in the head with his cane after Millbrae BART station "last stop" wake-up call, prosecutors say.
An Oakland man with a criminal past pleaded not guilty on Wednesday to attacking a BART employee.
Joseph Carnell Smith, 46, is charged with assault with a deadly weapon and assaulting a transit worker for the alleged May 2 incident.
Smith was sleeping in a BART train when a train operator checking for passengers at the last stop in Millbrae woke him up and ordered him to leave the train. Smith walked about 10 feet from the car before charging and then attacking his victim with his cane, prosecutors said.

Smith struck the transit worker on his chin and hand, prosecutors said.
The BART operator suffered cuts but no major injuries.

Smith is in custody on $500,000 bail. He has six felony assault convictions, making him a third strike candidate.
Smith's case is set for trial on July 23. He has a pretrial conference scheduled for June 25.
