Local Man's Cruel Texts Bring Jail Time

Allen Grabovetsky is also forbidden from Facebook and MySpace activity by the court.

A Millbrae man who in December 2010 sent threatening texts to a friend was sentenced this week to 60 days of time in the county jail and five years of supervised probation.

Allen Grabovetsky had just turned 19 years old when, according to the San Mateo County District Attorney's Office, he began sending unexpected and frightening texts to the victim. On December 17, he wrote “I’m going to literally put a knife through your head.”

When the victim responded to Grabovetsky's text, and stated he would be calling the police, Grabovetsky shot a quick text back, saying the victim would "really have it coming," and "I'm going to murder you."

Two days later, Grabovetsky called the victim, stating “I’m going to kill you and cook your mom; Are your parents home? I’m going to show up and kill your parents.”

At that point, the victim called Millbrae Police, and Grabovetsky was arrested.

This was not the first time Grabovetsky had been in court related to stalking charges.

In July 2011, he pleaded no contest to felony stalking, and three months later was sentenced by Judge Robert Foiles to five years of supervised probation, 279 days of county jail time, to have no contact with the victim in that case, to possess no weapons or ammunition, to abstain from alcohol and other drugs (including marijuana), to chemical testing, to voluntary search and seizure, and to counseling.

In sentencing Grabovetsky this week, Judge Craig Parsons noted the defendant had violated terms of his probation. His probation officer had told him not to wear military uniforms in public, and to remove his Facebook page, both terms the court found he violated.

Grabovetsky admitted to the probation violations.

Parsons readmitted Grabovetsky to five years of supervised probation with the same conditions as his earlier sentence, plus 60 days of county jail time, and told Grabovetsky that he was prohibited from using any social networking sites, including Facebook and MySpace.

If you feel you've been affected by threatening texts and feel you may have been stalked, but are unclear about just what is involved in making that determination, we've found a clear explanation of California penal code 646.9 that may make things more understandable for you.
